JVB FURNITURE COLLECTION – TERMS AND CONDITIONS
GENERAL
The following terms and conditions apply to any and all purchases made by Customer of JVB Goods.
JVB means MICAWBER 643 (Pty) Ltd, (Registration number: 2007/025469/07), t/a JVB Furniture Collection.
Customer means you, JVB’s customer, who purchase Goods from JVB, including both the person or entity placing the order and the person or entity that makes the payment of any JVB invoice.
Goods means any and all products sold by JVB and purchased by Customer.
When purchasing Goods from JVB, whether online, in person, from the JVB showroom, or on general or special order, Customer agrees and accepts all of JVB’s terms and conditions set out herein.
Further, Customer consents to JVB communicating electronically with Customer and providing quotations, invoices and information regarding Goods, including, but not limited to, their manufacture and delivery as well as communication from necessary third party suppliers such as delivery companies.
DISCLAIMER
Final fabric composition, colour and texture may vary from the in-store or online display due to variations in dye lots, upholstery processes, lighting and the device on which Goods may be viewed.
Leather may experience variations in terms of the dye process, combination of multiple hides to make up a Good or natural characteristics such as marks, scars, scratches, tick bites, brand marks and the like which are not considered defects.
Natural solid timber moves in relation to moisture present in its environment. This may result in variations of colour, markings, cracks or other natural characteristics which are not considered defects. Solid timber is alive and movement may occur, this is not considered a defect or sign of damage.
Marble, stone, granite and quartz are natural materials and colour, marbling, veins, marks and detail may vary in each slab. These variations are naturally occurring and are not considered defects.
JVB Goods are intended for use in a domestic environment and not in a commercial or high traffic usage environment.
JVB may not be held liable for any of the above and Customer accepts the nature of the materials used in production. No returns, exchanges, cancellations or refunds, as set out in these terms and conditions, will be considered due to naturally occurring characteristics of materials used in the production of Goods.
PURCHASE
Prices displayed in store, on the JVB website or on social media platforms are quoted in South African Rands and are only valid for purchases and deliveries within the Republic of South Africa.
For orders to be shipped outside of South Africa please enquire directly with JVB for a quotation.
All prices are subject to change without notice.
All Goods are subject to availability.
Placing Goods in an online shopping cart does not constitute a valid order until full payment has been received.
Full payment of invoices, including any delivery charges is required before any Goods will be delivered to or released for collection by Customer. All Goods remain the property of JVB until full payment is received.
EFT payments will only be considered as received once the amount reflects on the JVB bank account statement. EFT payments generally take 3 business days to reflect, however JVB has no control, takes no responsibility and assumes no liability for how long an EFT payment takes to reflect.
Customer hereby declares that should payment of any amount, in excess of R50 000.00 (Fifty Thousand Rand) in aggregate, be made to JVB from an account other than their own, that Customer shall immediately declare to JVB the name of the entity or individual who made the payment, the nature of their relationship with such entity or individual and provide JVB with proof of registration or ID. Failure to do so will constitute a material breach of these JVB Terms and Conditions and JVB will be entitled to claim proven damages from Customer, including indirect damages where such failure and/or misrepresentation was intentional, fraudulent, or grossly negligent.
Original invoices must be retained for all warranty, refund, return or exchange purposes. No request for a warranty claim, return, refund or exchange will be considered without an original JVB invoice.
Any store credit must be redeemed within 6 (six) months of the credit being issued, after which any credit will expire and no longer be valid. A credit note must be retained as proof of such credit.
Any and all quotations are valid for 14 (fourteen) days from the date on the quotation. Should a quotation be accepted by a Customer after it has expired JVB reserves the right to refuse to honour such quotation and may provide Customer with an updated quotation.
ORDERS
JVB will provide Customer with a detailed quotation for all orders. Customer is responsible for verifying and confirming the accuracy of all information and any customised or specific detail on the quotation and JVB will not be liable for an errors or omissions contained therein.
Orders require a minimum 50% (Fifty percent) deposit in advance before any manufacture may commence, and must be signed off by Customer to confirm the order.
Once signed off orders may not be changed in any way or cancelled, any deposit will be forfeit.
Orders may not be returned, exchanges or refunded.
Full payment of an order, including any applicable delivery charge is required before any Goods will be delivered to or released for collection by Customer.
Any orders requiring specific detail may impact JVB’s standard lead times. An anticipated lead time will be specified on the quotation, order form or invoice. Lead times are provided for convenience only, JVB is not responsible for and may not be held liable for any delay or for any damage (direct or indirect) caused by such delay.
Orders are dependent on the availability of materials, workmanship and skills within the JVB factory, and the complexity of any customisation itself and as such Customer accepts that orders may differ from any showroom samples and swatches.
UNCOMPLETED PURCHASES
If the outstanding balance of any order, whether general, specific, custom or otherwise, remains unpaid for a period of 12 (twelve) months from date of order confirmation, JVB reserves the right to cancel the order. Any amounts paid by the Customer, including any deposits, shall be used to cover costs, damages, storage fees, administrative costs, and handling fees arising from Customers failure to make final payment and complete the purchase.
DELIVERY OF GOODS
Deliveries are charged to the Customer and are reflected on the invoice and/or quotation.
Deliveries take place Monday to Friday between 9:00 and 16:00. Deliveries are not made on weekends, public holidays, or outside of the specified hours.
Customers will be contacted in advance to arrange a suitable delivery date.
Delivery times may be provided where possible but cannot be guaranteed.
In the event of JVB experiencing a delay which affects the agreed upon date of delivery, the Customer will be informed telephonically in order to make alternative arrangements.
Should Customer fail to be available on the agreed upon date of delivery, or fail to provide reasonable access to the delivery address, and JVB are obliged to return on an alternate date the Customer accepts that JVB may charge an additional delivery fee which Customer will be obliged to pay before the alternative delivery may take place.
Customer is responsible for ensuring that the delivery address as well as the delivery area is fully accessible to accommodate the Goods being delivered in terms of space and size of lifts, staircases, doors, etc. The delivery area is to be cleared of other items and furniture in order to adequately accommodate the Goods being delivered. JVB delivery agents are not permitted to clear areas in preparation for delivery, rearrange Customers furniture, or remove unwanted goods from Customer’s delivery address.
No Goods will be lifted or hoisted over walls, through windows or onto balconies. Any required hoisting must be arranged by Customer at their own cost.
Customer acknowledges and accepts all risk of damage which may result from non-compliance with the above. Should delivery of the Goods not be possible due to non-compliance with the above, which JVB’s delivery agents may, in their reasonable opinion determine, then and in such event JVB may, at is sole election, require the delivery area to be immediately made compliant with the above, alternatively may elect to abandon the delivery and arrange an alternative delivery in order to allow Customer time to ensure that the delivery address and area are compliant. The cost of any alternative delivery will be for Customers account and must be paid before the alternative delivery is made.
Customer, or their authorised representative, are required to sign a proof of delivery document, as well as produce some form of identification, if required. If anyone besides the Customer accepts delivery of the Goods at the delivery address, they are presumed to be authorised to accept the goods on the Customers behalf.
All Goods must be thoroughly inspected by the Customer, or their authorised representative upon delivery before signing the proof of delivery document. Unless otherwise indicated, the delivery is deemed successful and all Goods received in good order and as per Customer specification on signature of the proof of delivery document. JVB may not be held responsible for any damage to Goods once same have been successfully delivered. Should Goods be incorrect or damaged Customer must notify JVB immediately, inform the JVB delivery agents and return the Goods to the JVB delivery agents immediately, and not accept delivery of the Goods. Defects or damage must be reported to JVB customer care on 011 262 4118. It is advised that photographic evidence is taken and forwarded immediately to info@jvb.co.za.
JVB may use third party service providers for the delivery of Goods. JVB are not liable for any damage suffered or any losses incurred arising out of any act or omission by a third party provider, its directors, employees, sub-contractors, agents or representatives. Customer agrees that JVB may share Customer’s personal information with their third party service providers so that they may effect delivery of Goods. For further information in this regard kindly refer to the JVB privacy policy on the JVB website.
COLLECTION OF GOODS
Customers, or their authorised representative, must produce an original JVB invoice, and if requested, some form of identification, in order to collect Goods. The person in possession of an original JVB invoice will be deemed to be the authorised agent of the Customer.
It is the Customers responsibility to check the Goods for any damage or defects before taking possession of the Goods to be collected.
Once the Customer, or their authorised agent, has accepted possession of the Goods JVB will not be liable for any and all damage that may occur, whether said damage occurs on JVB premises, or not, or in the moving, handling, loading, packing and transportation of the Goods.
Customer acknowledges that electing to collect Goods means that Customer will make suitable arrangements for the transportation of Goods taking into account their size, weight, loading, packaging and securing requirements which includes, but is not limited to wrapping, straps, ropes, padding and soft materials for effectively securing and protecting items.
STORAGE
No storage facilities are available at JVB premises. Once a Customer is notified that a Good is available, either for delivery or collection, delivery must be arranged for a date within 14 days of such notification, alternatively Customer must collect within 14 days of such notification.
Failure to accept delivery or collect Goods within 14 days of notification of the availability of the Goods may result in a storage fee of R150 .00 (One Hundred and Fifty Rand) per day. Storage fees must be settled in full before Goods will be released for delivery or collection.
EXCHANGE, RETURN AND REFUND INFORMATION
Once an order has been verified and confirmed by a Customer, as set out above, no request for returns, exchanges, cancellations or refunds will be considered at all.
Goods that have been modified or altered at the Customers request will be deemed to be customised orders and no request for returns, exchanges, cancellations or refunds will be considered at all.
Goods on sale or promotion are sold “as is” and no request for returns, exchanges, cancellations or refunds will be considered at all.
Goods purchased off the showroom floor of JVB must be inspected by Customers before they complete their purchase and will not be capable of being returned, exchanged or refunded.
Refunds for Goods purchased off of the JVB website, may only be made where the Goods do not match the images on the website and must be refused immediately on delivery or on collection. Goods may not be returned for a refund if they have been used, damaged, have been permanently installed, are attached or joined to other goods or property at the delivery address, if they have been taken apart, or if they are returned without any original packaging or without any accompanying accessories.
JVB may charge a handling fee of 10% (ten percent) on the purchase price any Good returned for a refund.
Refunds will only be paid into a Customers verified bank account, and wherever possible the account from which payment was received. Refunds will not be made in cash, even if the purchase was made in cash. All refunds are paid on the 15th of the month or the end of the month subject to JVB processing cut off times. Customer must allow 4 business days for any refund to reflect in their account.
Requests for exchanges are subject to availability of a suitable replacement Good at the time of request. Any Goods returned for exchange purposes will be inspected by JVB and will not be considered for exchange if, in the sole opinion of JVB, they are not in the same condition in which they were delivered to or collected by Customer. No request for an exchange will be considered without an original JVB invoice.
GOODS TAKEN ON APPRO OR HIRING
JVB does not supply Goods for either appro or hiring purposes.
WARRANTY
JVB provides a 12 month warranty on the craftsmanship of all fabric upholstered furniture from the date of delivery or collection, subject to the limitations provided below. The warranty does not cover leather or fabric which is subject to wear and tear associated with normal use.
JVB provides a 5 year warranty on the frame of JVB sofa’s, from the date of delivery or collection, subject to the limitation provided below.
JVB provides a 12 month warranty on the frame and/or craftsmanship of any timber Goods from the date of delivery or collection, subject to the limitations provided below.
The warranties set out above above provide for the repair of the Good only. A replacement Good will only be provided if, in the sole opinion of JVB it is not possible to repair the Good. Where any warranty is claimed the Good must be delivered and collected from the JVB showroom at the Customers cost.
Warranties will only be honoured if:
- The defect existed at the time of delivery or collection and manifested during the warranty period;
- The defect did not arise due to normal wear and tear;
- The defect was not caused by misuse or abuse by the Customer;
- The Good concerned is used for the purpose intended;
- The Good is used in a domestic environment and is not used in a commercial or high traffic usage environment;
- The Customer has duly complied with the care and maintenance instructions set out in these terms and conditions and provided on the JVB website;
- The Customer must produce the original invoice;
Warranties will be rendered null and void if any defect or damage was caused as a result of:
- Any alteration, addition or modification of the original design of Goods;
- Improper or inadequate maintenance;
- Improper or incorrect use of Goods;
- Exposure to water;
- Exposure to direct sunlight;
- Exposure the coastal or polluted air;
- Exposure to chemicals;
- Accidental damage by Customer;
- Normal wear and tear;
- Spills of solvents, ink, chemicals, paint, and the like;
- Bodily fluids (human or animal);
- Close proximity to sources of heat or light;
- Sitting on arm rests or backrests or any area or Good not designed as seating.
Goods purchased directly from the JVB showroom floor are sold without any warranty.
LIMITATION OF LIABILITY
To the extent permitted by applicable law, regardless of the form, in which any legal action may be brought, JVB, its employees, directors, suppliers and agents will not be held liable for any indirect, incidental, special or consequential damages or losses, whether foreseeable or unforeseeable, of any nature whatsoever and howsoever occurring.
To the extent permitted by applicable law, regardless of the form in which any legal action may be brought, JVB, its employees, directors, suppliers and agents will only be liable for direct damages for anything giving rise to any legal action for an amount equal to that actually paid by the Customer to JVB for the Good in question.
JVB accepts no liability, and Customer indemnifies JVB against any such claim, for any loss or damage of whatsoever nature due to any delay, accident, damage, loss, injury, death or any operational aspect of Customer, unless same is cause by wilful misconduct or gross negligence.
CARE AND MAINTENANCE INFORMATION
As with all natural Goods, it is necessary to follow a few maintenance and care instructions to ensure that your new furniture maintains its appearance. The following care instructions must be followed to extend the longevity of any Good purchased and in order to qualify for any warranty offered:
For all timber and wood Goods:
Maintain the lustre and keep wood supple by applying WOODOC’s deep penetrating wax as part of a regular weekly or semi-monthly cleaning routing. Pour a small amount of WOODOC onto a cleaning cloth and wipe on using circular motions the way one would apply a spray polish. Once applied evenly, buff the wax to a shine.
Do not use too much wax as a build-up will form and the shine will be replaced by a waxy film. If too much has been applied merely use a dry, non-abrasive buffing cloth and some elbow grease to buff the wax till the surface looks clean.
Use the yellow WOODOC interior wax bottle for interior applications and the blue WOODOC exterior wax bottle for exterior applications.
Be sure to treat wood in August and September particularly. In August the Highveld winds start and the moisture in the air drops dramatically, September then arrives with hot, dry days, longer and stronger sunshine hours with strong rays, all before the first rains of the season. Keeping your wood supple at this time is highly recommended.
Although wood Goods have been sealed against elements such as water and ultraviolet rays, these elements are still the greatest enemy and will still cause damage. Direct sunlight will darken wood. Water will cause it to mark, swell, warp and crack. The care instructions above may extend the life of your wood Goods and ensue that you continue you to enjoy your JVB pieces.
